Law - Essay Example A contract is usually considered binding once the acceptance is made to the offer and communicated to the offeror. The rules apply to the negotiations that have been made till that point to know to what extend are the parties obliged to fulfill their promises. There is no halfway through, the negotiations will either be binding in the contract or not binding at all. An offer is communicated when the offeror indicates the terms on which he wants to make the offer such as the price of the goods, and gives a clear indication that he intends to be bound by those terms if accepted. Acceptance means that the offeree has unconditionally accepted all the terms of the contract put by the offeror (Andrews, 2011, p. 7). The second element of the contract is that the agreement made under offer and acceptance must not have vague or incomplete negotiations. The agreement must be certain to make sure that the contract is binding. For example when the offeror makes an offer saying that the salary will be mutually arranged between us, the courts hold no agreement between them since the agreement was not certain between them. Some of the factors that affect the certainty of a contract are provisions for clarification, the terms implied by statutes and the previous course of dealings. If there is a provision given to clear the terms later then the agreement will be binding. Secondly, if there are some terms that are implied by statutes though not being agreed by the parties, the contract will be binding. Thirdly, if there are some terms that are understood due to the previous dealings between the parties, the contract will be binding (Harriman,  2009, p. 13). Upon arriving at the scene of the murder at the home there was a collection of witnesses that were at the location during the shooting. The first individual the author interviewed indicated that the shooting occurred as a result of a drunken accident. The second witness that was spoken to indicated that while he did not witness the actual shooting, he had overheard the two individuals arguing in a fight that grew increasingl y loud before gunshots went off. The final witness was the individual involved in the actual incident who stated the deceased shot himself with the gun not knowing there was ammunition in the chamber. While the exact incidence of the shooting is not known, it’s believed that the first witness, who is also the brother of the individual that was involved in the shooting, is covering for his brother. It’s believed the second witness is being accurate in his description of the conflict that occurred before the shooting. Finally, believed that the individual involved in the shooting is lying to cover his involvement in the crime.

Some of these theories are worth noting. For instance, James Frazer (pp. 232-246), an anthropologist of evolutionary school of thought, places religion in a nonlinear hierarchical evolutionary ladder in which, the first step is magic followed by religion and subsequently by science. He argues that the earlier people were not aware of the ‘real’ reasons behind the natural processes and so, came up with explanations that now sound fantastical and unlikely. These explanations form the realm of magic and soothe the human anxiety when the mind could not find any other explanation. However, man soon realized that magic could not work in all situations and there has to be a definite propitiation of the higher power in the way things pan out in the universe and thus religion was born. A ccording to Frazer (pp. 256-278), it came out of a need to reconcile the ideal with the real i.e. the happenings of the real world were not explained completely by the human intervention alone and thus the need for a divine explanation was born. A related theory of Sigmund Freud, the famous psychologist, presents religion as a response to the need of putting the responsibility of one’s action off to a higher invisible power, usually male which represents the innate need of man to be able to depend on a strong male figure. Although highly infamous and usually discredited, this theory does lay sufficient groundwork in answering the question of why people need religion in their lives and why, more importantly, it provides them the comfort that it is reported to provide. However, the most intriguing and interesting feature of the religious discourse is its diversity. The religions across the world are diverse in all respects. Some base their belief system on the existence of one God, while others believe in a series of gods and goddesses; still others seem to reject the idea of God altogether. These religions are monotheism, polytheism and atheism respectively (n.d., 56). This is the most primary way of classifying religion. There are other ways too. Some religions stem from myths whereas others from revealed books. Some religions revolve around a charismatic leader or an inspirational figure, whose guidelines form the foundation of the ethical conduct of the religion. The comparative analysis of the religions is one of the most popular streams in religious discourses in present-day academia. Scholars take great interest in juxtaposing religions to each other, comparing different common units to each other. The scope of this paper limits itself to such a comparison between two world religions namely, Islam and Hinduism. The paper tries to compare and contrast Islam and Hinduism in several respects and approach some platform of commonalities and differences between the two.
